1 - General conditions of sale

These general conditions of sale (hereinafter referred to as "GTC") govern all contractual relations between Danielle SIMON Création  sculpteur residing at 2055 route des sylvains 261200 CHABEUIL in France (hereinafter referred to by "the artist") and any person wishing to make a purchase of one or more sculptures (hereinafter referred to as "the purchaser"). These T&Cs are the only ones applicable and replace all other conditions except prior written derogation.

By validating your order you accept without reservation after having read the T&Cs.

1- Presentation of the sculptures
The sculptures on the site are all unique pieces made in my studio in Chabeuil. In the event that the purchaser wishes to obtain additional information about the characteristics of a sculpture, he can contact the artist by e-mail at the following address danielle.simon74@orange.fr and/or by telephone at +33( 0)6 08 09 86 34.

2- Conditions for placing an order
Prior to placing an order, the purchaser must provide all the information necessary for the registration and processing of his order. He fills in his billing and delivery addresses.

The purchaser must via the site complete the order form and send it to the artist who will validate the order with the purchaser if the piece is still available.

3- Price
The sale prices are indicated in euros and include all taxes. Shipping costs are extra and payable by the customer, they are specified to the purchaser prior to the final validation of the order. Packaging costs are offered by the artist.

The price of each order, including delivery costs, is payable in cash upon confirmation of the order.

Depending on the country, customs fees could be claimed, it is up to the purchaser to find out and pay them if necessary.

4- Information
Each sculpture is a unique piece.

5- Method of payment and delivery
Payment is made by bank transfer via the site. Upon receipt of payment, the order will be carefully packaged in a double cardboard package, it will be protected beforehand in bubble plastic and shipped with its certificate of sale. The sculpture will be sent to the address indicated on the order form as soon as possible, generally 4 to 7 working days. The artist communicates the tracking number of the package.

  In order for these deadlines to be respected, the customer must ensure that he has communicated exact and complete information concerning the delivery address. The mobile phone number or the email address are essential for a delivery.

Deliveries are made by Colissimo. Each package is delivered to your home by hand.

6- Liability
The artist cannot be held responsible for late delivery or loss of parcels by the carrier.

7- Right of withdrawal: deadline and conditions for canceling and returning the order.

the buyer has 14 days to change his mind. After this period, you will no longer be able to exercise your right of withdrawal.
The buyer therefore has  a period of fourteen (14) working days to return the product(s) he has ordered if he/she does not not give him complete satisfaction. This period runs from the day of receipt of the order. The product(s) must be returned in its (their) packaging to the following address: Danielle SIMON Création  2055 route des sylvains 26120 Chabeuil. If the aforementioned conditions are met, the buyer will reimburse the buyer, within thirty (30) days from the date of receipt by the buyer of the package (the date of receipt by the buyer being worth notification to the purchaser of the exercise by the purchaser of his right of withdrawal), the sums paid by him. At the end of this period of fourteen (14) days, the products delivered will be deemed to comply with the purchaser's order and have been accepted by him.

8- Copyright
Article 111.1 of the Intellectual Property Code

The author of a work of the mind enjoys on this work, by the mere fact of its creation, an exclusive intangible property right and enforceable against all.

  No reproduction can be made.

9 - Applicable law, settlement of disputes
These T&Cs are executed and interpreted in accordance with French law. In the event of a dispute, the purchaser will approach the artist in order to obtain an amicable solution. Any claim by the purchaser must be made in writing. In the absence of an amicable settlement  you can contact the mediator. As a last resort, the purchaser may choose to bring his claim before the competent French courts (Commercial Court of Romans sur Isère).

10- Acknowledgments
The artist would like to thank the purchaser for his order and his trust.

All the information in your Account is only used within the framework of your commercial relationship with the artist. This information is never shared with third parties or resold. Finally, your banking information is never in our possession. Transactions are entirely processed by our partner's secure payment module.
